TOT: You sure the wife didn't do something to help with the business? Billing? Office work? etc. I'd definitely try to get it on Scd. C, but if there was a way to have both of them on Scd. C, under the same LLC, that would be the way to go since both of their names may be on the papers filed with the Sec. State. Take a look at instructions for Scd. C this year because this is a new law allowing both to be on the Scd C. The LLC should be fine on Scd. C, as it's disregarded anyway. CrowJD 17:40, 14 April 2008 (CDT)

Got your message. Sounds like the LLC was simply never used, and is not an issue. I agree, go ahead and use Scd. C for H's sole prop. sounds like a plan. The key thing is that you are picking up the income from the 1099-MISC's, and I would not worry particularly how they are titled. I'm sure things like this happen all the time. CrowJD
