Fred,

I am the Cobleskill grad and former Albany resident. Having grown up in the area I still have a lot of family and friends residing in the Albany area. Most mail me thier stuff and we complete long distance. However since I started my career/business in San Diego and did no tax work in NY I would love to have someone I could refer the more complex returns to (Corps, Farmers, SE etc....). Would you be interested in these referrals?

Can you provide me some referrals for other professional - attorney's (trust & Estate), financial planners, insurance etc. My folks are getting older and have set up a trust but they have little knowledge or experience and I can't give them a recommendation. I don't know or trust the people they found in the yellow pages.

On a side note my Aunt and Uncle owned Borelli's for many years, good memories. Lastly and as strange as it may be, is Pizza Shack still in business?

Kyle again, the only cobleskill grad wearing shorts right now.

I have a nys problem with a client of mine. He worked in NY (in the city) for three months and then moved to Boston for the remainder of the year.

W-2 He earned $38282 in 2006

NYS $38282 Box 16 NY W/H $551 City wages $12274 (this is all he earned in NY) City W/h $332

Mass $26007 Mass W/h $1319

In theory you would think he was a NY resident the entire year and or worked in NY the entire year but he was clearly a part year/part year individual.

Through Lacerte I have NY taxing $38282 and MA taxing $26007, no credit for other state etc Seems to be double tax by the states, employer stated NY taxes you on the entire year whether or not you worked or lived in the NY.

Is this correct?

My folks (still in Albany) need a good trust attorney can you refer one or two to me? I had them set one up about ten years ago, but I would like to get it reviewed as they are declining fast.

Editing pages

I saw your post in which you mentioned you didn't know how to edit pages. It's really very simple. All you have to do is make sure your at the top of the page then click on "edit this page." Hi Fstein,

I truly appreciate your time and whatever advise you could share!

I have been thinking about opening a small sandwich shop/cafe where I could serve a few of my mom's recipes. 5-10 years down the road, i'd like to expand that operation to a full menu restaurant, if things work out. I've started writing a business plan a month ago, but I really do not know where to start!

I'm always entertaining friends and family and they all seem to REALLY love what I have to offer, and I enjoy it so much. I love being creative, I love cooking, and I love entertaining. The only reason I'm doing this accounting thing is because that's what I studied in college. That's it. Anyway, It's all mediterranean recipes and competition is almost non existent (suburbs of Dallas, TX). Now I know that passion for cooking could be fun when it's done in my leisure time but it could be completely different when it becomes the source of my livelihood! I've heard about the stress, long hours, risks, dealing with customers, which seemed to deter me for a while from proceeding with this project. However, I know down deep inside that this is what I'd like to do. This is where I see myself 5 and 10 years down the road, not ina tax/accounting office!

I am married with a 10 old month baby, and my wife has a great job that is our primary source of income!

Let me stop here, because I have a lot of questions and concerns, and I can't seem to gather my thoughts properly. But I'd like first to hear about your experience and what you have to say!

I'm curious (after your post to me)about the practice you purchased, if you're in the mood to share. How large was it (# of individuals, # entities etc) and how many have you lost due to those price increases you mentioned?

I've slowly built my practice thru referrals mainly; I know I underbill based on "value" (I seldom have to write anything down tho)and struggle with bumping the fee on clients I've had for a while.

You did see those spreadsheets Kevin posted yesterday? I downloaded them, but have had a chance to really look at them yet.

Fred-Glad you saw it. I pulled that from a website where a someone posts photo of his funny or his favorite things. Among his favorite things is news women. The women in the photo must be a news anchor whom he has the "hots" for or some actress. He's a bit of a character. I have no idea because he posts a bunch of those and then will find a funny photo and put it up amongst the women. I thought the peep one was pretty funny. He has some really funny stuff. Fred, in almost forty years of practice, I have never, never encountered such a situation, and to be honest, had never heard of a lump sum solution (except for the 10-year averaging type). I am afraid anything I say would be a case of 'blind leading blind.' Your client is lucky he did not come to see me.

You wrote (and I quote so I can see the question while I answer it):

Once upon a time (and not so long ago, I think, because RIA Checkpoint's explanations seem to think it's still the case), NY required a part-year resident who had NY source income during the part of the year when he was a nonresident to file two returns - an IT 201 for the resident part of the year, and an IT 203 for the nonresident part. Now, however, NY has caught up with the rest of the world, and you do it all on the IT 203. NY income for the year consists of the sum of (a) NY source income (e.g., salary for services performed in NY) earned during the period of nonresidence and (b) all income earned during the period of residence. See the IT 203 instructions.

Note that CT will tax ALL of his income earned during the period when he was a CT resident -- not just the part the employer withheld CT tax on. CT will give him credit for the tax he pays to NY on that income. The employer was correct to withhold NY tax on the NY source income, since CT in effect cedes the tax to NY via the credit mechanism.

Rotten pistachios

I just read your post. I used to love to eat pistachios. Every once in a while I'd get one with a really bad taste. Then I popped one in my mouth, got the bad taste, spit it out, and found a small worm in it that had eaten most of the nut, so I realized what I had been eating on the bad ones. Haven't eaten a pistachio since! Hope you're all better now!

Aw sweet jeezus. It's looking like a monstrous preposition. There is a lot of research I'm trying to look through. Up next is SUTA dumping liability and the employment tax rules that got put in place recently (not sure what all it adresses, but my hunch is that it was to combat the off shore leasing scams). Then there is ERISA...

Honestly, most of the routine issues we know about taxwise from doing payroll. The HR and benefits law stuff is also fairly easy. FLSA, FMLA, COBRA, USERRA, Portal to Portal, and Ledbetter are all pretty easy stuff to understand and a lot of good guidence from the .gov . Not sure how ADA and the anti discrimination things will work out since we wouldn't be making any decisions in that matter, but I guess liability exists in a matter of course. HIPAA just means you have to keep your mouth shut about employee health and medical issues.

There are a few major feasibility problems as I see it: 1) Benefits pricing. It's all based on volume and experience ratings. I was going see if I could get an el cheapo health plan as a POP or a full fledged §125 plan. Also a set up a SIMPLE IRA system with a bank. 2) Workers Comp 3) What happens when they don't pay? Lord knows I spend enough time shagging after bad checks for my fees, but what happens with a PEO. 4) Lack of uniform policies. I can't even get clients to pay estimated taxes on time. I kinda doubt I can get them to follow proper procedures.

I think I'm just going to stick with taking aboard the hr functions instead of forming a fully fledged PPO.

We'll see, I'm still researching the issue. I've found a guy on a labor law forum that has a bunch of experience, so I'm going to bounce things off of him.

Different by State

In my state, attorney discipline (ethicical violations) is ultimately handled by the Ga. Supreme Court, managed through the State Bar of Georgia (the State Bar gathers the facts).

I am not sure who has ultimate authority in other states. I'd start with the state bar association of that state (sometimes they go by different names). Don't confuse a local bar association for a state one.

It's not easy to find a history in my state because each incident recieves a separate handling and case number by the Ga. Supreme Court. It is much easier to find a current status from the State Bar, however.

P.S. note that the discipline status tells you nothing about the malpractice history....But you have the same problem with doctors. CrowJD 18:38, 30 June 2009 (CDT)

Keep checking

The state bar usually bends over backwards these days to help the public, so you could call them and see if they can't point you to a history. They should NOT ask for your name, there is no need to in my opinion, just tell them you are a potential client.

I know that my state's website has gotten better. I think you can find disciplinary decisions back to 2000 or so. Before that, I don't think there was a centralized system. It's still not indexed, even today. So, you have to scan down the cases by year.
