Thanks for the advice and I will by the book...I just got my EA and I have been working for fortune 500 companies for 17 years...I am glad I am out there as the situation is not good right now...I started an accounting business about 2 years ago and my tax return business is growing with accounting business..I understand the tax returns but sometimes a complicated issues come up and I find this website very helpful...I am sure more tax returns I do more issues will come up as everyone has their own tax issues..thanks agin

Crow, when you see topics on the Consumer Forum and you don't think they should be there, feel free to put a note on my talk page and I'll either move 'em back to the tax forum or explain why I don't think they should be moved.

In the case of the Phila tax question, the OP posted duplicate questions on multiple forums and had not provided a profile (that was on 3/11). They were asked to update to indicate whether or not they were a tax pro. And their question was in the grey area - not definitely worded like a tax pro would, but also not definitely worded like a consumer would. If it hadn't been for their duplicate questions that had to be deleted (generally a sign of someone who hasn't taken even a minute to see how TA works - i.e., a DIY), the post may very well have stayed in the tax forum. So I can understand why people are questioning this one.

10 days later (yesterday), the OP came back and provided a profile that identifies them as a lawyer, but not practicing as a lawyer (at least that's how I read it, it is a little cryptic). A lawyer asking Q for a client, that's be moved back to the tax pro forum. A lawyer asking a question for himself in another capacity (e.g., for his own company), well, he needs to be referred to a tax pro. And that's what the consumer forum is for. But since both you and D&T believe this one should be a pro question, I've moved it back. It might be an idea for one of you to make sure that Easy has enough tax chops to handle this on his/her own...


Anyway - in the future, you can put a note on my talk page about other discussions you think are in the wrong place. Or on the discussion itself, as you did this time - but I don't actually read all the answers on the consumer discussions once they've been moved - I usually just check on the additional posts from the OP in case they self-identify as a pro or something that might allow me to move their discussion back to the pro forum. So on my talk page would generally get faster results. (Can't answer for Kevin though, be may read everything!)

We give them a link

Not that they all know how to click and/or otherwise follow a link, but any time we move a discussion, we leave a note on their talk page that says why and where it went. Some of them ignore those notes, but lots of them find their discussions and post follow-ups (even though the note specifically redirects them to other resources), and if they do that without also updating their profile, then their subsequent new discussions get moved, too, since they've obviously made a choice not to claim "tax pro" status. So, anyway.... you may not need to feel sorry for 'em after all!!

NRA to NRA query

Hi Crow, On a serious note-Is there a flaw in the thought process ? 1.Deposits are defined as intangibles 2.Ownership of the account is 50/50 3.Having spoken to a few professionals , they all indicate that funds (form of money,not mutual funds etc ) are intangible .

No worries. Not expecting a legal opinion/advice. merely looking for feedback/leads . I have researched this quite a bit (PLRs,Blacks law dictionary,court rulings,other professionals) but have never seen a case which combines NRAs and joint accounts situation. Accounts are definitely designated as intangibles.Just did not know how to apply the joint tenancy rules . Most articles I have seen look at the contributing parties and then apply the RA/NRA/Citizenship rules to it .

Oh, yeah, I know, believe me. Everytime I post on that topic I wonder...oh, will that ever come back to bite me? Listen, I've got a query off to the attorney that I work with regularly, and I'm facing something I've never faced before, feeling like I have to do work for a client that I'd rather not because he's become a jerk. But he blames me for his life trouble, and I'm caught between trying to keep him as happy as I can so that he doesn't pursue me for something, and wanting to stop working which just keeps the clock ticking on his vengeance one day. Here's what I sent to the other attorney, love to hear your thoughts: (I know it'll be worth what I pay!) Here's the situation. Long time client with great relationship got behind giving me books, by a year. I tried everything I could to help her get up to date, including having others try to come in part time to catch her up. Nothing changed. Finally, IRS descended, and much to my and her husband's surprise, whacked them. She had not paid a years' worth of payroll taxes totalling a 100k. Also the union, and their main supplier. 100k each. Biz had gone soft, and she just kept it all to herself, never told a soul.

They close the biz, planned to file bankruptcy but haven't yet, even tho' that was all back in 06/07. The husband has become abusive, and seems to think that I didn't do enough, or should be blamed somehow (how can you blame your wife and still have a sex life?).

Frankly, I want nothing more to do with it. The 15th looms, and I suspect that she's hoping that I can somehow get filings done by the extended due date. They have someone willing to pay, so that could be big money. But I'd almost prefer to just let this go for fear that I'm going to get drawn into bankruptcy filings and all manner of crap. And their records are spread amongst several attorneys working on various parts of deals and looming bk, so some of it might even be made up at this point, from which I'm supposed to file tax returns...and those end up in bk court looked at by a judge...when my confidence level would not be high as to accuracy.

My dilemma is wondering if he can still take any action against me in the belief that I should somehow be liable, which is crap on it's face and pretty easily defendable. My last work done for the corp was the 06 1120S and 07W2's. Or am I better to keep enemies close by continuing to do the work that I can and get paid well, and just keep him at arm's length? JR1

I honestly don't have any issue with it being moved....politics you know. I must say that I am surprised that tax professionals can have such varied opinions on items that I feel are factual. We aren't talking social policy here, facts are facts. I suppose that there are so many facts that each side can curry in its favor that waters get muddy.

However, I don't know how you discuss the topic put forth without discussing the fact that there is a clear distinction between the parties on the issue. Democrats have discussed varied ways to get your IRS / Retirement accounts under the control of the US Government. How successful they would be at it, that's a matter for argument--I personally think that it would ignite a civil war. But the facts are clear, the democrats (how you feel about that fact is up to the individual) have been circling the wagons around your retirement accounts. I will personally yank the accounts and spend every penny of it before I give it to the government to be wasted or borrowed from.

In either event, I respect the opinions of everyone...even those I might disagree with. Always glad to hear your colorful and fun comments.

Looks like it was taken out back in August when you deleted a few of the love letters you got from your many admirers. Do you want it restored? I know some people like having it gone – Harry, for example, took his away ‘cause he says that means he only gets notes from people who can figure out how to do it the hard way. Ha!

What you say, bud, is very true. They recently were successful in getting the UK to adopt Sharia law. I am hoping they don't try that nonsense here.

My biggest problem overall is that Christianity is always blamed for the ills of our society and when anything happens with Muslims, we tap dance around it these days. Case in point: the terrible Ft. Hood massacre. This clown is a devout Muslim and mainstream press reports were hoping he was named "Smith" or they were not releasing the name until they were 100% sure. What a joke.

Like I said, I have a client who is a devout Muslim. He fled Iran in the wake of the revolution as he was well-educated. He was fearful as an intellectual of being imprisoned. He says the hard line Islamic fundamentalists are just insane. On 9/11, I called him to see how he and his family were and two of his colleagues were killed in the Pentagon crash. He told me that besides the terrorists hijacking the planes and killing 3,000 innocent people, he said this, "They've hijacked my religion." TomTaocpa 20:28, 15 November 2009 (CST)

I do recall...

I do remember you are Catholic and to the left of John XXIII. Me, I like Vatican II and I don't like the changes heading towards conservatism. Too many are listening to the Mother Angelica and EWTN crowd. When I went to the Papal Mass last year, there was so much kvetching afterwords about the whole liturgy. The conservative Catholics on EWTN went nuts over the music, the prayers, etc. A friend of mine (we grew up in the same neighborhood and he is now a priest) planned the liturgy and got it approved by the Vatican. These people were angry with him. They forget the word "communion" means sharing in common in Latin or fellowship, i.e. community. We are one body in Christ.

I have to be honest: I can't stand people making broad, sweeping, generalizations like David (Anarchrist) has done. That's why I went down the road I did. According to his website, he went to Evangel University, a very conservative Christian university. Maybe something happened while he was there. Anyway, it's not my concern.
