Is this enough to make the surviving spouse liable for the tax debt? The deceased spouse underwithheld and owes $2000 + for each of the unfiled years.}} | ||

| I have a client in Oregon whose spouse passed away in 2004. The surviving spouse has filed seperate returns since 2002. The deceased spouse had not filed since 2002. Is the surviving spouse liable for the deaceased spouse's underpayment of tax? | |

| Any person receiving property from the decedent is potentially liable for unpaid taxes of the decedent under the transferee liability statutes. What, if anything, did the surviving spouse receive from the decedent (before or after death)? | |
