I have a client in Oregon whose spouse passed away in 2004. The surviving spouse has filed seperate returns since 2002. The deceased spouse had not filed since 2002. Is the surviving spouse liable for the deaceased spouse's underpayment of tax?

As Riley2 said, the surviving spouse is not liable. But if the decedent has assets, the decedent is liable. If the decedent's assets went to any person then that person is liable for the tax to the extent of the assets received.
