because my client has several k-1s that always file extension, he can only file until he gets all the k-1s but back in march, his wife, for some strange reasons, does not want to wait. so client asked me if he and her newlywed wife in 2008 can file "married filing separately", i told him that he might lose some tax benefits, i won't know until i see all the k-1s, but generally not a good idea. his smart wife took my client's W-2 and ran both scenario under her turbo tax and told me that turbo tax said there were no differences so she went ahead and file as married filing separately......fast forward to today, i get the k-1, there is a 22,000 rental loss (active participation).....disallowed because they file married filing separately, he owes tax now as oppose to get tax refund if he were to file jointly. i thought i share this story with you all because i got a kick out of it.

now to the real question, i am thinking of filing an amended joint return so do i just take wife's as the original and make all the adjustments on 1040X?

well, first you have to get wife's permission

then the answer is YES. You will be amending her return, since he has not yet filed.
