Accounting Students Using this board
As you can tell, I've been a poster on this board for the last few weeks. I learned about it from a Quickbooks seminar on the 2007 Quickbooks Accountants Edition. I really enjoy participating in the board, and in responding to questions. However, I do resent accounting students coming here asking us to do their homework assignments, work out their specific tax problems because they want to avoid having to pay an accountant under the notion that they know something about accounting/taxes. You've got one on there now - a freshman accounting student with a husband who is a medical malpractice attorney - who just wants us to give her answers, because with her limited knowledge believes she's going to do everything on her own to avoid consulting with someone who does know. She apparently isn't familiar with payroll tax issues, tax ramifications, compliance filing - but expects that with her limited basic elementary knowledge - is going to come here for answers. If she's not stopped, she'll probably come back here again. How are you able to stop this practice?

Good morning,
I just want some clarification on the 351 transfer of assets & notes payable from a Sch. C to an S-Corp. Situation is this: Trucks & equipment NBV are around 200,000, loans are around 100,000. Some of the trucks are fully depreciated, but still carry notes. (Don't ask how/why-previous tax preparer deducted mileage AND actual expenses!!!.)
I believe I transfer the assets at lesser of FMV or book, & transfer the notes at principal balance. But do I do it in total? That is, on the eqpt that's fully depreciated, the taxpayer is transferring zero basis, and being relieved of a liability. Is this "gain" taxable? When I read Sec. 357(c)(3), concerning liabilites assumed, I am a bit confused. When I transfer these notes, they do not create/increase an asset. Give rise to interest expense only. Therefore we leave the N/P's out of the equation????? I'm confused.
Also, an unrelated question. If the Sch. C "rented" the equipment/trucks to another C-Corp, would this be SE Taxable? It appears to me this is the rental of personal property.............

Sorry for the delay in getting back to you with any ideas. You had talked about the limitations regarding namespaces, categories, etc. and it gave me an idea that I hope could work and be considered for implementation.
As I write this, I notice that "All Topics" is composed of 6,261 posts of which 5,941 are from the Tax Questions Forum. Since so few questions / comments (only 320 as of now) are in the other "Discussion:" namespaces **combined**, can we do the following:
1) Change the namespace of the current Tax Question Forum and code it as available to everyone. That is, paid preparers who have completed a profile, self-preparers and anyone who has not completed a profile stating that they are a paid preparer. Making the "historic" forum available to all does not disadvantage anyone retroactively. And, as time goes on, only OPs from self-preparers will be posted here.
2) Add a second Tax Question Forum called Tax Questions From Paid Preparers (or similar) and give it the same namespace as above. This one would be coded as only available to those who have filled out a profile and checked a box stating that they are a paid preparer. (Pseudonyms could still be used for those who wish to remain anonymous.)
3) Create the mashup that allows the two forums to be viewed at once a la "All Topics" in the "Discussion:" namespace.
Those who have created their profile and checked the paid preparer box (or perhaps one of the following boxes: CPA, EA, Attorney, Paid Preparer, etc.) could bookmark in one of three ways: a) Forum with OPs from self preparers; b) forum with OPs from paid preparers with profiles; or c) the combination of the two forums.

Side-Effect of Switch From Beta

When TA was still in beta, "my talk", "preferences", etc. were in the upper right-hand corner of my screen. After the switch they are in the upper left-hand corner. The problem is that the TA logo, which has not switched places, covers up "My Talk" and probably one other choice that I cannot remember. The only choices I see now are "preferences", "my bookmarks", "my contributions" and "log out".
Similarly, ". . .this IP" and "Create an account or log in " used to be in the upper right-hand corner, but have switched to the upper left-hand corner. The ". . ." above is what is hidden by the TA logo.

Beta Side Effect

I actually use Avant Browser; however, I competely forgot that it is an "overlay" of IE. (So much so that when you click Help / About it only gives the Avant Browser Build Number rather than including the IE version as well.)
At home I, in fact, did upgrade to IE7 while at work we still use IE6. And lo and behold here at work everything is in the correct place.
I *love* coincidences. And I *love* Microsoft.
Ironically, I just received my latest e-mail from Steve Ballmer regarding how great Microsft is and how it will make me taller, more handsome and richer. All I have to do in exchange is drink the Kool-Aid.

Hey there Tim. I have to say one thing; I am disappointed in some of the members here and even though I know you can't do much about it, I just needed to vent.
There are some almightier than others here who post answers in very harsh and insensitive words. I watch the forum sometimes and don't post at all for this very reason. Some of the new members tend to think they know "EVERYTHING" and then talk down to those who don't know as much.
This is only recently that I have seen this and I hope and pray that new posters here will not be reluctant to ask questions for fear of humiliation on this board.

I love tax almanac but as it is with anything else on the internet, you can take what you need and leave the rest but is there a way we can all approach each other with respect and not post things which are negative on the person and or their expertise?

I blanked out your phone number and email address that you added to this page. It is common for automated "robots" used by spammers to view any and all webpages they can find to add phone numbers and email addresses to their collection for spamming purposes. I'd hate for you to start getting spam due to your posts on TaxAlmanac.
Yvette left you a message here, but to reply to her, you'd need to go to her talk page. Only then will she be notified that you have responded.
Also, a better way to begin private communication is to go to her page and select "E-mail this user". That's the safest way to send someone your phone number or email address without announcing it to the world. In order for this to work, the other person must have added their email address to their preferences. If they haven't, they can go to your user page and send you a message in the same way. If you need any help with this, just let me know.

Mendatory Profile
Hi Tim, First of all let me thank you for doing such a wonderfull job maintaning "Taxalmanac."
Two suggestions: 1) Make profile mendatory to use this site. Without a profile it is very difficult to know expertise of the user.
2) Add a column "Original Post Date." Sometimes users answer a question after six or more months later and it goes on the top of the list. If it is very old issue I do not like to read it again (unless it interest to me).

I'm enjoying using TA. The interface is comfortable to use; and, I'm beginning to use the resources. I would like a more specific search tool. For instance, when I just want to see a specific IRS document, say a Code section,0 I would like be able to go there without encountering the rather broad results that are presented. I also find browsing resources such as the IRC tedious. I also wish there were more members who were more forthcoming about their profiles. The scarce personal (really professional) info. makes be question credibility and even motives at times. I find it off-putting when someone remains anonymous or who seems to represent themselves as expert and posts authoritative-sounding material. Real names would be nice. So I'm trying to be somewhat careful in who I respond to as well as the topics; and, in the quality of my postings. That means doing some hard research which is time-consuming. I knew about linking to Publications, but sometimes, it's quicker for me to copy and paste the URL where I looked up something, usually at the IRS site from a bookmark on my home page (out of habit). For an example, after you edited the Pub URL that I posted a few minutes ago, users now have to click three times to get to the link that I posted (that would have taken one click, if the link had remained unedited). Since your edited link finally gets to the IRS site after three clicks, is it incorrect for me to continue posting links that go directly to the IRS site and which go to the exact spot in the Pub that I intended? I just want to make sure that I'm not breaking any rules here, but I also try to do things the quickest way.

Ok, yes, I do understand why you prefer TA links. I didn't think about the fact that the IRS may change their links in the future.
As far as the three clicks: (1) clicking on the link in my msg, (2) then clicking on either HTML or PDF on the TA Pub page, and (3) then clicking on the section title at the IRS (HTML version) to get to the section I was researching. My link went directly to the section in the Pub at the IRS.
From now on, I'll link only to TA and then will add further instructions in my messages telling people where to find the information in the Pub.

Like the majority of other users, I'm only interested in the discussions here. Most tax preparers aren't writers, so I can understand why articles are not being written on TA. I understand what you're trying to do, but I think the discussions are the most helpful to tax preparers and individuals.
Thanks again, and I do appreciate all that you've done with this site. I know how time-consuming it is for you, because I used to have two large web sites, and I literally spent most of my waking hours maintaining the sites and editing pages.

New Idea
Sounds like a great idea, and I had a feeling your idea was about something like this. I think it would really help to have categories set up, and I wouldn't mind at all helping out with this. I also agree with you about messages floating to the top after minor edits, and I've wished there was a way to get around this. So, when do I start? I have the Bad Debt message edited, but I haven't saved the page yet, because I assume something needs to be done first to set up the categories (the links are currently red when I previewed the edit).

Adding the topics is another great idea! When I went to my New Messages page, I thought I saw a message from you that said your idea was to add only two topics, but when the page actually loaded, that message was not at the end of my messages, so I don't know if I imagined seeing that or not. Please let me know if I'm adding too many categories. Yea, this is addicting, but I'm wondering if I should quit for awhile, since I'm starting to bring up messages older than 24 hours.

I think your ideas to add more to the Community Portal are great. After you've added the new descriptions, posting your changes to Tax Questions would help bring it to everyone's attention. Hi Tim,
Regarding Energy Credits vs Credits, there are about 20 credits available, such as, earned income credit, child care credit, energy credit, child tax credit, tuition credit, etc. But I'll leave it up to you. Just let me know if you prefer one category titled Credits. Also, thanks for letting me know about clicking on the red links and creating pages for them. I wasn't aware that I could do that and will do that now from the Category pages. Then I should get to work.

I wondered what Deb was up to! She was refreshing so many things...and I didn't see her tracks. I use Avant, which is a skin over IE with multiple tabs like Firefox and Opera. I just discovered last Fri. that I could have it auto refresh every so often depending on what time frame I asked for. So what it was doing was refreshing, while I was writing...and making it go away! Have now ended the auto refresh thing, too bad, since it was handy. Ah well. Sorry for alarm.

I've gotten through the forms and publications you have listed here, but I still need to organize the Individual and Expenses categories. Some entries need to be added or deleted from those categories to be more logical, but I have to stop now and go get my pacemaker checked and then start on the year-end work (which will take the rest of the week). I'm pretty sure I'll have some time at night in the next few days to get back at this. I have a feeling I won't have much time to add categories to the discussions until after April 16th. I'm a little nervous about doing that too much, due to the "floating" problem and the confusion it causes. Thanks for allowing me to help out!

It sounds very good to me. I found nothing I thought should be changed in the wording. One thing I've been doing when creating pages for new categories is to just type "& n b s p ;" without the quotes and spaces, but I don't know if this is important to mention or not. Deleting Discussions
Thanks, Tim, for letting me know how to delete discussions. I'll check it all out later (sounds easy enough), but I wanted to let you know what happened, in case you weren't around then. The user posted the same question twice, and one of the messages had a subject title of RE only. I added a category to her other message that had the correct title, and then D&T answered her question in the bad RE message. So, I quickly pasted his message into the correct title message and then changed the title of the bad message to Please delete this, Tim, so that others would not respond to the bad message.

Tim - when you say cut and paste to get RR's into TaxAlmanac, I tried this but get lost. Secondly, I do not find a complete listing by year at the IRS web site. Tax Links has them, but assumed you did not want them coming from that site.

Deleting Bad Messages

I tried this on the current "1031 Excange" message that is blank. I deleted the top line, and the message did not disappear from the Tax Questions forum listing, so I'm not sure what I'm doing wrong.
Since then, the user typed his question into the message, so I can't delete it now, but I guess I need a little more help with this.

Never Mind?
I think I know what happened. The user probably had that message open, typing his message (on his 2nd attempt), and that could be why the message didn't get deleted. Before I wrote to you the first time, I had added back everything that I deleted the first time. I'll get this eventually. :)

Articles and LLC
Hi Tim,
I did realize what you meant by articles the other day after we first discussed it, and then I realized it was something I could do. At some point, I realized that text from the IRS could be copied into articles here, so it's basically creating pages (using non-copyrighted material, links, actual writings, etc.) and organizing it all on a page (which I've done in the past many times--the web sites I used to have had about 5,000 pages. I spent a lot of my time from mid-1996 through 2000 in Editpad--but I was also winning substantial prizes from Geocities, which I sold on eBay and to a local computer store, so I had an incentive to continue working on those sites--until Yahoo bought out Geocities, and then I deleted the sites near the end of 2004, due to being bored with them).
At the time I created the LLC category, I didn't realize you already had a Limited Liability Company page. If I had taken the time to look around some more, I might have found that and would have included a link to that page. But I think your edits are perfect! It looks great. Thank you for letting me know what you're working on, which helps give me more ideas on how I can help some more.
I realize there's a lot more to be done here, but it would take a lot of time that I don't have right now. But I'm going to try to add more categories today to some of the current articles and other things, as I find them, etc. I have three more year-end accounts to work on, but they haven't been dropped off yet, so I should have some time today, once I find some energy. :)
Actually, I just remembered I've had three tax clients drop off their documents, so I probably should get started on those. Don't know if you'll notice that I added this last paragraph.

Deleting Messages

I tried this a few minutes ago (deleted the top line in the discussion) and even tried again by deleting all three lines in the bad message, but the message didn't disappear. So I just left it the way it was originally. I guess I'm doing something wrong. I'm deleting the entire {{ForumThreadHeading|Tax_Questions|Tax Questions}} on the top line in the "Individual Pin Numbers in Pro" message that is blank.
By the way, just FYI, I also ran a popular BBS in mid-Michigan (with four phone lines, six computers, about 100 online games, about 1000 message bases, and about 60,000 shareware files) from 1990 to 1997. I still write batch files, use DOS quite often, and have built over a dozen computers. I also was a Beta tester for Intuit for a year or two, just after Intuit bought out the company's software I was using. I started with CPAid in 1990 and then I ended up with Intuit in about 1996 or 1997. Intuit has been by far the best tax software, but I really hope the problems mentioned in the above thread can be fixed soon.

Deleting Spam
Hi Tim - I'm sorry to keep bothering you with this problem, but I just deleted the top line in the "How would you like to pay ZERO Tax?" discussion. I refreshed the page a few times and even went to my home page and deleted my cache. (My MSIE browser settings are set to show me the most recent page.) The message is still listed in the Tax Questions forum. Just wanted to let you know about the problem I'm having and the recent spam message.

Thanks for letting me know a little history about yourself, too, and thanks for the interesting links. I noticed you have Adams in your family. My maiden name is Adams, and I'm related to the two presidents (Adams)--but on my mother's (Smith) side (they are distant cousins, a few times removed). She did family research for almost 50 years before she died, both the Adams and Smith sides, and also found that I'm a distant cousin to the two Roosevelt presidents and possibly to Brigham Young (but no exact proof). I wanted to help her, but she was stuck on all of the lines for years, and there wasn't much I could do to help her, so I went to the libraries with her and researched my ex's (Ackley) line for awhile and then forgot all about it after we divorced in 1982.
New Problems in the 2006 ProSeries Pro Software
Sorry for the delay in responding to this. I've been trying to decide what's important to report as problems in the program. I think I'll go ahead and just deal with entering the full birthdates, especially if there turns out to be no problem efiling incorrect birthdates for dependents when the year is correct. (If it would be too time-consuming to find out full birthdates from clients, I think I'll enter 07/01 but haven't quite decided yet.) The most time-consuming thing for me will be to check the "automatically enter PIN numbers" box. The discussion for this is here: Individual_Pin_Numbers_in_ProSeries_Professional Last year and prior years, that box was automatically checked for all clients, and I didn't need to check any boxes or enter PINs.
The additional questions that now need to be answered on the EIC worksheet will be pretty time-consuming for me. That discussion is here: EIC_-_Automatic_Due_Diligence_is_No_Longer_Automatic. In that same discussion, I also mentioned that I now need to enter my PIN on every state return for the city return--even when there is no city return to be filed. That step could be eliminated if the state module would get my PIN from the Federal module.

Where Does 'Summary' Show Up?
When I post, there is a box for 'Summary'. I have started filling it out but don't have a clue as to where it shows up. I thought it might be in the email change notifications but I haven't see it there (or no one else is filling it out). I certainly don't see it in the discussion itself. Yes, that would be a great idea! Then everyone would know about the discussion. I could also copy and paste the messages I recently wrote to JR in the new discussion area. (I've always wished there was a reply feature when answering personal messages, too, but don't know if that's possible with Wiki.) Good idea, Tim!
City Tax & PIN Problem
I thought I would be more specific about the PIN problem in the State/City program. In order to efile the Federal and State returns, I have to enter a five-digit PIN in the PIN field under "If third party designee is NOT preparer". This question relates to the city return, whether there is a city return included or not. I just verified this by opening up a client file with no city return. I still have to enter a PIN number in that field, even though I'm the preparer and third-party designee. This field is only for third-party designees who are not the preparer and only when a city return is included, so this is definitely a bug in the program.
If there is someone else at Intuit that I should either write to or fax bugs like this, I would be happy to do that, but I don't know where to send messages like this. There used to be a form within the program that I could type up problems and then send the messages to Intuit, but I don't think that's been available for a few years. I don't want to bother you with things like this, if I should be directing them elsewhere.

No, I guess I never paid attention to that link. Thanks for bringing it to my attention. I would have already added categories to tons of discussions, but I've been staying away from that most of the time, because I don't want those discussions moving to the top with my name listed. If this problem is ever fixed, I would probably spend a lot of time doing that (especially after April 15th). I might get back to the articles today or tonight and do the rest of those on the Business page (under General Info), starting with S Corporate. Then I'll need to go deeper into some of the main headings to find more articles to categorize. I've also noticed that some IRC pages can be edited and some can't. Same with the Regs, so I haven't done anything with those pages.

MSSPs
I started working on that for a minute, but then got distracted with more questions. It's not easy to do both, and right now, I keep thinking I should be resting, instead of sitting at the computer all the time. This is probably the last day I'll have no "real, income-producing" work to do until after April 16th. I like doing this stuff sometimes, but it is zapping the energy that I'll need for the next three months, and I have a feeling I'll regret not resting when I could and should have. I could spend hours on the MSSP and ATG pages, but I don't think my lower back can take much more of this. So, I'm not sure what I'll decide to do the rest of tonight. :) Plus, I could tell you were working on it, after I started, so that's another reason why I decided to quit for awhile.

Tim, although I'm one of those Joe Does who pop up now and then on TA by choice or accident, I'd like you to know how I feel. You're doing a fantastic job and you're a fine man. I'm already addicted to the site. I also like Sandysea a lot. She's so genuine. Have a dumm question: is there a way to see the latest post on a thread first?
