An SS# and ITIN?

I have had several hispanics come to me for tax prep. They have filed with another firm in the past. The siutation is they have w2 with a ss# but also have an ITIN. They said the ss# is to work with and the ITIN if for filing tax return. Am I at risk if I file their return? Are these people being taken advantage of by someone?

ITIN

I deal with a lot of Hispanics that are not legally entitled to work. The SSN may be a fake one which they purchase on the black market. They do not use it to file a tax return. They use a ITIN to file their tax return.

When I get a client in this situation, I do not file any tax return with the fake social security number. More so, because I am aware the client is not the real owner of the SSN. I file a tax return with the ITIN. Ask the client to be homest with you about the SSN.
