Your question has been moved - no profile
Your question has been moved to the Consumer Questions Discussion Forum because it does not appear to comply with the guidelines established for the tax forum, which is intended for use by tax professionals only.
If you are not a tax professional, you will likely be advised to seek out a local tax professional who will have the opportunity to understand your entire business and/or tax situation and can provide both advice and follow-up. This is not simply a brush-off, it's because (a) simplistic answers to questions that are more complicated than you may even realize can be more dangerous than helpful to you, and (b) the users on this site actually make their living helping people like you answer questions like yours, and are not always inclined to do the same thing for free.
If you do not yet have a tax preparer, you might find How to find a local Tax Professional to be helpful.
You are, of course, welcome to use the yellow search box (upper left corner of screen) to look for info that might be helpful to you in better understanding the issues you face. And, once in a while, the tax professionals who come to this site to get and give advice to each other will also help out non-professionals, but often the situations that are presented are not the kind that can be answered in a quick post or two.
Question's been moved back
Thanks for updating your profile - that helps a lot in determining whether questions meet the guidelines for the Tax Forum. Your question does, and it has now been moved back to the Tax Forum.
If you would like me to delete the duplicate discussion you just started, please let me know.

deleted your duplicate discussion
Hi, Ozzie -
I now have deleted your second (duplicate) discussion. Your recent post bumped it to the top of the forum list, so there’s more of a danger that people will respond on the wrong one. Better to keep it all in one place, which is what I think you were trying to do.
Just for the historical record, here’s what the duplicate one said:

Taxpayer entered into a contact to sell his farm. Buyer put down earnest $$ and put in more each time he asked for an extension of the closing date. Earnest $$ would be applied to the purchase price if the deal closed. If the deal fell apart, seller keeps the earnest $$. Deal fell apart. Does the seller recognize ord. income or capital gain?

Your first question about this had several responses: Discussion:Forfeited_Earnest_Money_Income, and it's now been moved back to the Tax Forum. Also, per Kevin's suggestion on that discussion, here's a sample of search results: Earnest Money - as you can see, there are 23 discussions with "earnest money" in the title, and 40 or so more that mention it in the text. Of those 60, about 30 also show in a search of both "earnest money" and income, so there's bound to be at least one that helps you answer your question while you're waiting to see if anyone else adds to the existing responses.
Please post any responses to Ozzie in the original discussion, linked above. Thanks!

The following is the "link". Not very internet savvy, so you may have to type it out yourself instead of clicking on it.

If link does not work, you can go to www.hallestill.com and look under newsletters. The April 2006 newsletter, last page has brief commentary.
