You can, but you need to consider child labor laws. He should, although it is not mandatory, apply for a EIN#; there are many advantages to hire family members (maybe, again maybe, no unemployement tax to be paid, no social security matching, etc.), but it may get complicated in regards of the legal custody of the child (does he have it?) and other issues. I would not jump in this without knowing a lot more (just to cover yourself). Anyhow, he is so desperately looking for a deduction? Also, depending on the state, he may need to carry Workers Comp which can be pretty stiff. Bye
