Insurance agent issue

I am a tax accountant (CPA) in Jacksonville, FL. I would be interested to see what the IRS's stance was on this issue. Did you receive correspondence from the IRS dis-alowing the treatment? If so, I'd love to see it, (with tax payer information removed). This is a topic that is discussed in our firm quite frequently, and I would love to see actual documentation on the issue. I posted a couple of cases that we're run through the legal system, but both are quite dated. In both cases, the taxpayer lost the arguement because the 1099's were issued in there personal name.
