Taxpayer made contributions for an HSA in 2007. W-2 shows federal wages lower than state wages by the amount of the contribution as a "pre-tax" deduction for federal purposes. Based on how the W-2 is reporting the wages I am assuming that a Form 8889 is NOT necessary as this would then give taxpayer an adjustment to income & would give him a "double benefit". Does that sound right?

Also, does anyone know if this pre-tax contribution is subject to FICA/medicare?
