Senate Finance
I checked Uncle Fed's Tax Board, http://unclefed.com/Tax-Bulls/index.html but that reference only goes back to 1989. I have a copy of the Joint Committee's Explanation of the Tax Reform Act of 1986; it was published by CCH at that time and is over 1000 pages in paperback and on Page 245/246 is a discussion of Active Participation.
The wording is similar to what I wrote and is the intent of the lawmakers. I can copy these pages and fax them to you [my old flatbed scanner has been put behind a wall in this house] but I also think if you have access to a good law library, you might find this there since I suspect the Appeals officer will want more. What I could also suggest is that many IRS offices have reading rooms where these documents can be found, and I think if you asked the Appeals person to read the Joint Committee report on the intent of the framers in defining active participation, he or she just might.
