I have an S Corp client seeking to sponsor an employee on a H-1B VISA. The application requires proof of EIN.

For clients older than say 20 years who no longer have the S Corp papers, EIN docs, how would we prove this number?

We Efile every year no problem, use ADP no problem, etc...

Is there a way to verify this or prove to a 3rd party?

Wouldn't the front page of a tax return do the trick?

would that be a privacy violation ยง7216.

just thinking out loud, but if I recall you could release taxpayer info to government agents like IRS, but does that include all government agents?

Terry, isn't the S corp. disclosing its own EIN?

Yes, I suppose so.

Interestingly, when you use ADP or Paychex, they absolutely ask for some form of evidence from the IRS, a payroll notice would work.

However, a tax return copy is not acceptable to this agency. Not even an EFILE ack form.

In the "good ole days", the 941 monthly payment coupons would be sufficient.

Have the client call 800-829-4933 and select the option "EIN" and tell them you need an EIN verification letter. When we were assisting clients in filing BP claims the BP claims administrator wanted that on everyone, we had the clients call that number and 15 minutes later the letter was faxed to us. We couldn't do it for them, the client had to call.

When requesting the EIN from that 1-800#, request a Form 147C. Also, if you have a POA on file for the client - you are authorized to make this request.
