I am using ProSeries software trying to e-file a same-sex couple in MA. I successfully e-filed their separate federal returns as Single. However,when trying to e-file MA state return MFJ, the return is marked as "Not Ready", and an error message shows saying "A return with the same SSN/DCN has been marked for electronic filing." Any advice on how to e-file this return?

Sorry if I touched a nerve - I didn't mean to upset anyone, I'm only asking for help. I agree with you and get angry that they have to file separately and single for the federal - very wrong! I am trying to make this work so that they can file married in MA. I only worded it that way to make it clear why they were single on federal and married filing jointly for state.

I assume you have made the dummy return

in Drake you would tell the 'single' file 'do not e-file any state'

and in the dummy MFJ state return, 'do not e-file Federal'

I truly don't know if you can create 2 files with the same SSN with Drake

Yes, in Proseries I have created 3 files: a federal for each and on each I selected that the filer is in a "Same-Sex Marriage" and that the return is for federal purposes only - no state e-file is selected. On the MA MFJ return I selected that it is their return prepared state return purposes - no federal e-file is selected.

The easiest way is to have them mail the state out. The awkward solution is to load Proseries on another computer, then you can efile the state. Despite MA being a direct efile state, Proseries prevents it because it sees the other single Federal. The new database on the second computer won't recognize that a federal with the same social has been filed.

Same problem when you have MFJ with different periods of residency for MA, MFS required.

Try this. File just the Federal return, then after it is accepted, go back into the file and unmark the electronic filing option. This should remove it from the e-file homebase. (You may have to close and re-open the program, or even try the database maintenance feature.) Then e-file the separate state returns. When they are accepted,go back and click back on the e-file options, and all will re-appear in the e-file database. I know I've encountered this scenario before, and it can be done, but you have to trick the system.

I was going to suggest the same approach Spanish mentioned. This has worked for me before.

I had the same issue with a CA return, except I got the CA mfj return filed before getting one of the the Fed. single returns filed. It took customer service about 30 seconds to fix the problem for me, unfortunately I'm new to proseries and I didn't quite follow what they did. I'm sure they can solve the problem with a phone call.
