Notice 2007-11, 2007-4 IRB gives more information on the refund of the excise tax, including more details about deceased taxpayers, and businesses no longer in operation.

According to IRS FAQ, if a business gets a refund of the excise tax, it must declare it as income in 2007. Why should a business even bother with it?
