I have only talked to this client on the phone. I have a situation where H died without a Will. Wife would take a 1/4 part thru intestacy (there are 3 adult children). She will be surprised to learn this as I have not told her yet. Anyway, anticipating that she will want the other 3/4, I was thinking of a Year's Support Proceeding.

Anyone had experience with the tax angles of these? She would potentially be awarded the 3/4 she did not get as a "years support" (it's considered an expense of administration). These are not damages, but in the nature of support.
