I have a client that is terminating their Section 444 election. Their fiscal year was 9/30/08 and I will be filing a short year tax return as required for 10/1/08 - 12/31/08. My question iss whether I have to file the 8752 for the 9/30/08 fiscal year end. My client owes money and would rather not pay the amount only to have to wait for a refund.

I am presuming that it isn't required since he will owe the tax for the short year on 4/15/09 which is before the 8752 is due, thereby negating the tax deferral issue. However, I haven't been able to find anything in the tax code or regs that give me a firm conclusion on this.

If you have knowledge about this can you please let me know.
