| Hey guys,
I recently accepted a contract job to do simple 1040s and 1120s for a local tax prep firm. After the first week I got a statement and my pay: 10.00 hr + 15% commission. My question is it right to charge me a software fee when the firm is running a unlimited version of Lacerte? The formula they are using 75.00 - 40 (software and administrative over head) x15%. So if I figure i'd just do 1040s only, it will be 10.00 / hr + 5.25 per return? Any insights? | |

| There was only a Non disclosure agreement of clientele information and a attached fee schedule of their prices. The owner wasn't comfortable with a contract that determines lenght of employment and yiddy yadda. He was telling me he's been in the business for years and one of the most reputable person to work with in the community.
I just called for some clarification. Commission is based on 75 - transaction fees if paid by cc - software fees - administrative fees - shipping fees (if I were to request to work from home) = gross * commission rate. I also mentioned they forgot to add in the share of EO insurance hehe. | |

| So it sounds like it wasn't spelled out clearly. Perhaps there is still room to negotiate since you are just starting. You have no control over what they charge ($75 fixed fee) or what the expenses are, except possibly the amount of shipping fees. Since it was not clear to you there would deductions, it seems to me that it would at least be worth your time to question the owner about this. And if you have your own E&O, I would recommend you tell him you're already covered. | |

| 1040 and D.
I have just talked to the owner over the phone and he has been doing this for years and chastised me for questioning. "Is this you first time preparing taxes?" I mentioned the E&O for humor hehe. $75.00 is his fixed fee that he pays out as commissions. I'm actually going to go in tonight and grab my calculator and laptop and leave. I was contracting out to see if anyone wanted to outsource some of their returns and to reduce their work load and he was the first to call. Since I'm not a EA or CPA yet so I don't think I have any negotiation power over it. Thanks for your input guys! | |

| Not all practitioners work this way. I worked for another CPA while I was getting started. I went to her office and charged an hourly rate. I also charged mileage. I'll be working under a forensic accountant next year for a few projects. I'll be paid an hourly rate with him as well. It sounds like the guy you're working with is looking for someone he can treat as an underling or employee rather than a co-professional. | |

Whether or not you have letters after your name does not spell...non professional. Try to get something that makes you feel self employed. You can negotiate when ppl know you are a business and you are attempting to build your business!! | |
