I have a client who went to Mexico to have Lap Band surgery? Is this at all deductible? No doctors note, all by choice.

I have a client that went to Duke about 6 years ago to have his stomach stapled. Doctor's note and was on SS disability because of his weight. About 3 years ago he went to Mexico to have the excess skin removed (with US doctor's note). Attached notes to the return and have not had any "nastygrams".

Not deductible unless medically necessary. That does not mean it is OK to do so. Note: 99 % of the item that are not deductible placed on returns result in ZERO nastygrams.

You'll note that my client had a doctor's note saying that this was medically necessary and he was drawing SS disability because of his weight. He said that his doctor said that if he did not have the stomach stapling, he would die and that the surgery was extremely risky with only a 50% chance of survival. This is why I felt comfortable taking the deduction.

Your skin removal was Dr approved. Thats sounds medically necessary to me.
