I have a client who was paid salary for doing some work with her US Corporation. The client lives in South America. Taxpayer did not live here the whole of 2007 and is not a US citizen or resident alien. All Taxpayer did is do distent work and got paid by her US company. Withholding taxes were withheld. Can you suggest as to whether this person can file a US tax return in view of the facts given above?

Client should file Form 1040NR to get a refund for all of the taxes that were withheld. She does not owe U.S. tax. The U.S. corporation should not withhold tax on salaries to nonresident aliens where the services are performed outside the U.S.
