Client has a vacation property owned jointly with son-in-law. House rented 28 days in 2008. Son in law spent 17 days there. Client spent 65 days there.

Is this 14 days for each for the rental, so not a vacation property? Income not taxable and expenses not deductible (except mortg int and RE tax)? Or, does it count as each of them renting it for 28 days?

Total use = 110 days, personal use would be 82 days or 74.54% and rental would be 28 days 25.46%, still vacation home.
