| Client, a US citizen, married a non-resident alien wife in 2006. Their child was born in 2007 in the foreign country. The wife and the child did not come to join him in this country on immigration visas until December 2007. Here are the questions:
1) Can he file MFJ and claim his child as his dependent on his 2007 1040? 2) Could he file MFJ on his 2006 1040? Thank you for your advice. | |

| What country? Yes on MFJ but need to deal with ID #. Also will have to elect to be taxed on worldwide income. No on kid unless lived in Mexico or Canada. | |

| Thank you for your replies.
They are from China/PRC. Both mother and child obtained their green cards in December 07 when they came here and now they both have TINs. It looks like for 2006 they could have filed MFJ (wife had no income from China no worries on the worldwide income issues)and for 2007 MFJ with dependent child. Good day! | |
