| what can a truck driver deduct if he lives in his cab. it seems to me he takes his tax home with him and cannot deduct anything, not even miles??????? is this correct

| this is all hypothetical for academic use only. So if he is a transient, how can he deduct any travel or transportation expenses since he carries his tax home with him

| was he a qualified or unqualified transient? and it depends on the kind of truck he drives and the kind license he holds, and what states he drives thru. does he drive to Alaska? you have to be very careful with these transient truck drivers, make sure you get a retainer,...and a license plate #.

| Neil, you might try IRS Pub. 463. There are quite a few Tax Court cases where itinerant workers were denied "away from home" living expense deductions because they had no home to be away from. Neil D. Staley, TC Memo 1991-409, for example.
However, as far as mileage is concerned, his "revenue miles" (i.e., miles traveled while carrying revenue-producing loads) would surely be deductible. He would probably be better off to claim the actual cost of running the truck than mileage, though. | |

| This issue was discussed in a CPE session I was at. The the legal terminology describing the taxpayer in this case is that he is a turtle and carries his home with him so he is never away from home. | |
