I sure wish I had the tax code memorized. A client works for a property management company under salary. The company is talking to her about changing her to commission and a housing allowance. She has heard that if they put more to the housing allowance, this wouldn't be taxable. I know everything is taxable unless it is specifically excluded. Does anyone know if this could be excluded somehow?

She a minister? Accountable plan of reimbursements for living expenses for the convenience of the employer? Alas....people wanting to skirt FICA....hehe

It depends. For example, if her job is to manage a 500 unit complex of condos, the employer could require her to live on the property for the employer's convenience and as a condition of her employment with the company. In such a case, the employer could conceivably give her free housing.

If they are giving her a housing allowance that allows her to decide where to live, no dice.
