Cannot find the answer anywhere on this...

Client filed separately in 2006 while going through a divorce. Her attorney just called me and said she couldn't file separately because she is in a community property state. I thought that this is only if we had to file the state itself, not federal return.

Am I wrong?

You can file MFS, but you may have to allocate the community property income and expenses between the two. Pub 555 is useful.

I live in Louisiana, a community property state, and I've never seen this. I have clients who file MFS for federal all of the time. Louisiana follows federal filing status.

The way community property works here, she gets the property and he has to leave the community.
