| My father passed away last year and as I gather should not have received a $300 stimulus payment. Is there any specific guidance on where to send these checks back or what the procedure is? | |

| It seems your fathers final tax return was filed after his death and he received the $300 because he had social security during 2007 of at least $3,000.
Good news! Based on an IRS update May 12,2008 you do not have to return the $300 check back to IRS. The $300 should be part of his estate and distributed to beneficiaries according to his will or living trust | |

| I've really hesitated about doing this, as my father passed away in 2007 and my step-mother 2 months later in 2008. I guess it's kind of like wondering if I should use my father's assets to pay for his wife's care until spent out since she was covered under Medicade. Had a real 'moral' dilemma about that. Fortunately/unfortunately, my fellow beneficiaries had no qualms whatsoever. As fiduciary of the estates, I wonder if I would be remiss if I didn't file a (otherwise unneeded) return for them? Just because you can, should you? | |

| You didn't have a "moral dilema " about ensuring your father and step -mother file an accurate 2007 tax return.Why do you have a "moral dilema" cashing the stimulus checks that are legally the beneficiaries ? As fiduciary of the estate you have a key responsibility to ensure the estate is properly distributed . | |
