Filing a paper 1040 return with taxes due. Spouse is incapable of signing the return. Can taxpayer sign the return on behalf of incompetent spouse? If so how must it read.

Yes.

It would read

(signature), By (taxpayers name), (husband or wife)

If the incompetent person is the wife, I interpret this as the taxpayer signing wifes name, by "Prints his name", husband

Seems to me that husband would need to have a durable power of attorney to do that - or be a court appointed guardian of hsi incompetent wife. As a practical matter, may not make any difference.

I believe Jake is right, I was provided these same instructions by an attorney how works for a major law firm. All he does is tax appeals work.
