| Filing a paper 1040 return with taxes due. Spouse is incapable of signing the return. Can taxpayer sign the return on behalf of incompetent spouse? If so how must it read. | |

| Seems to me that husband would need to have a durable power of attorney to do that - or be a court appointed guardian of hsi incompetent wife. As a practical matter, may not make any difference. | |

| I believe Jake is right, I was provided these same instructions by an attorney how works for a major law firm. All he does is tax appeals work. | |
