| I have not been putting the sales of Lottery on my Sales tax returns for clients. I am based in California. My thoughts are the sales are not income, only the commission and I have not been using that either. How are others treating this item.

| Sales of lottery tickets are not subject to California sales or use tax. Cal. Gov't. Cd. ยง8880.68.

| 'Twas not the question, KJ. He wants to know what to report as nontaxable sales, the gross or just the commission. In NY we never put lottery on the Sales Tax return at all.

| According to the SBE Audit Manual, Ch. 9 for Grocers, Para. 0902.55, [1] lottery receipts are not part of a retailer's gross receipts for sales tax purposes, and auditors should check to be sure that they are not included. Also, in "Tax Tips for Liquor Stores" [2] the Board states that sales of lottery tickets should NOT be included in gross receipts on the sales and use tax return.
