Client asked about a form that his employees can sign that passes the liability and responsibility for tip reporting on to them.

He's not talking about not paying his share of taxes on tips reported, but more about liability in the situation where employees are underreporting their tips.

And, to be honest, his employees do report a good amount of tips for hours worked. Average amount of tips reported per hour are almost $7.00 for 4 tipeed employees.

Not sure whether this is a federal form or a NYS form he is talking about. Any ideas?

Thanks,

Fred

Are you talking about a tip reporting agreement? I wouldn't say it limits liability, but it does limit certain audits.

It might be that. Client said NYS Unemployment Auditor mentioned something to him about it. And he might have meant the protection from audit.

It looks like it might be that. I need to talk to him again.

Thanks
