The Service issued a ruling that a mortgage broker is not engaged in real estate trades or businesses -- even though state law may require him to have a real estate broker's license.

What ruling is that? I have never treated their activities toward qualifying as such, but I would be interested in citing authoritative literature.

This was a TAM issued quite a few years ago. I believe that the TAM has since been withdrawn. Not sure why. Clearly, lending activities are not included in the definition contained in Sec. 469(c)(7).
