| In a decision handed down today, State Appellate Court rejected the contention of R Quarto and J Prichason, a same-sex couple who had exchanged marriage vows several years ago in British Columbia, that they could file a joint New Jersey 1040 for 2006. It would appear that this will be possible in the future, but because the state's Civil Union Act was not adopted until February 19, 2007, they could not do so for 2006.
What struck me reading the opinion was that their accountant calculated that their taxes would be $411 greater if they filed jointly, but they pursued the suit. | |

| Yes, times have indeed changed. On another message board I frequent (the theme of which is more professional-to-layman than this forum)a common complaint is, "Why should I marry my girlfriend if its going to cost more in taxes? No way we're getting married in that case." At least this couple put their civil union before dollars...yes, times have changed. | |

| In California, Registered Domestic Partners are now required to file jointly or MFS. The same folks will be single or head of household on their federal returns. | |

| Ref: I hear that same refrain, but if they live in NJ or PA, ask them if their partner wants to pay 15% Inheritance Tax if they die single, and that happens even if the property is titled in both names [though only on 50% of the net value]. | |

| Allow me to extend congratualtions D&T...for the wedding that is, not the cyanide. My wife and I passed 31 years last month. In some ways we have 1040man beat, as I always double the time I tell people we've been married, which brings us up to 62 years. I think its absolutely hilarious when I tell people I double the number because it seems like twice as long...although for some reason my wife doesn't seem to see the humor in it, go figure.
Kevinh5, I don't think 1040man is complaining about marriage at all. As we can see from this thread, it seems that nowadays straight couples don't want to get married, while same-sex couples are very enthusiastic about doing so. Being from a previous generation, I must confess that I too become baffled sometimes over all this...its a good thing taxes are so clear and straightforward or I would have no basis at all with which to stay connected to realty! | |

| This is a second for both of us. Pam lost her Joe to a brain aneurysm in 1993 and I lost Morgan to Congestive Heart Failure in 2001.
I do think this is a burgeoning field in tax law. | |

| I am a mayor in NJ and I've perfomed about 125 weddings and more recently six civil unions. One of the nicest part of the job is bringing people together regardless of their preferences. | |
