I have a client that I justed set up payment plan to both fed and state tax dept for 2005 underpayments. Client was talking to state about plan and state agent told client that they do nat have a 1997 tax return on file. State asked no more questions about. Client called me and very worried saying that he does not have a return from before 1999 and asked should he call feds to request 1997 fed filing? I told him to relax and I ask some tax people what we should do. Any thoughts?

Does he know whether or not he had income for that year? It seems like he would have received a notice a long time ago if he had 1099's or W-2's reporting income to him if the state really hadn't received a tax return. If he did have income, I would request a copy of federal 1040 to see what's going on.

The state and/or the Fed not having a tax return on file is not unusual. For unknown reasons I have had clients file returns certified mail and later receive letters asking for the returns. Both individual and business returns. I would confirm with the client if he filed all returns, 1997, 1998, etc....., ask who prepared them and go from there. Until the state demands a return for 1997 I would wait but also follow Warren's advice.

I agree that unless the state asks for the 97 return I wouldn't worry about it. Sometimes in cases like this you just have to reassure the client that no one is going to haul them off to jail in the middle of the night over it.

Had an agent from State of IL walk into a client a few weeks back and said that they were changing their database, and discovered that a corp return wasn't filed for 1985! And wanted it!! I called our local IL Senator...haven't heard anything more. No one's got records 20 years back, or shouldn't anyway...

Rather than request a copy of the 1040, I'd request a Record of Account and Wage/Income (IRP) Documents for that year from the IRS. That will give all the information needed and you'll get it much faster. There is no cost for that information.
