I have a new client that has been working on an international adoption for 2+ years now. They finalized their adoption at the end of 2007 and are back with the child.


The problem is that the government agency responsible for issuing the Certificate of Citizenship is behind and their Certificate is overdue. As a result, the client indicates that they can't get a Social Security number with their new child as a citizen until they get this Certificate. If they get the Social Security number now, it would have to have a citizenship status other than American citizen.


Any ideas on what to do about the lack of a Social on this child? They want to file their taxes asap because they will receive a large refund due to the adoption credit.

Has anyone applied for an ITIN lately or have any feedback on the realistic timeframe for getting one?


On the website, the IRS states 6-8 weeks.


If he applied for the ITIN by February 15th, he would probably be okay for filing by April 15th. However, by then the COC would have come in (we think) and he could have applied for and received the SSN. If, however, the COC is delayed for a very long time, he would have passed the outside deadline for the ITIN application.


What to do, what to do? Which branch of the Government to trust most.....hmmmm.

As I think further, the TIN would probably be out because the child papers would not be acceptable to the IRS, our you could walk them in instead of sending them to Texas.

Actually, I found what I needed....I had to dig for it and test the limits of google, but I think this applies to our case:

Absent the proof of citizenship, the child can be issued a SSN based on the documentation given by the DHS when entering the country.

If your clients are in a hurry to file the return in order to receive the refund, you can file the return, for the child you can indicate that the SSN has been applied for. Once your clients receive the SSN you can amend the return in order for your clients to receive the additonal refund, if any.
