Most businesses require undocumented workers to get a social security number any way they can. This usually results in bogus social security numbers acquired at the flea market. I believe it would be better for the undocumented worker to use form W-7 to get an individual tax identification number and then have the business give the undocumented worker a form 1099. IRS Publication 533 states on page 3 "to pay SE tax, you must have a social security number (SSN) or an individual taxpayer identification number (ITIN).

Hi. I´m a 27 year old business men from Mexico City, and I would like to know if that ITIN (W7 form) number you are talking about will help me to open a LLC in the U.S.? o dont want to break any law, I had been seraching for hours about this issue and there is plenty of information from the U.S citizen point of view but non from a Foreign citizen point of view. is a big niche believe it or not..

I'm 99% sure you can use a ITIN for registering a LLC. You would have to ask the state directly if you can register with an ITIN. Also depending on the type of business you are registering, you would have to find out if you require a special license which may require you to have a Social Security number. You must be a citizen if you elect to be an "S" Corp.

Sorry Janet. Don't have to be a citizen but must be a resident of the US. Item #4 under Who May Elect for the instructions for Form 2553 "It has no nonresident alien shareholders."

An ITIN number is to be used for the sole purpose of filing a tax return.
