| I have a client who just informed me that she has not filed her organization's (ministry) 990's since 2001; of course she now wants to catch-up on and get them all done. I have ProSeries all the way back through 2004 but do not have 2002 or 2003; does anyone know if and how I could obtain so that I can do those years also. Is there another way to accomplish those 2 years? | |

| I found myself in the same position several years ago. I just called ProSeries and they sent me the program CD's for the years I needed--no charge.
A few weeks ago I spoke to an IRS representative in the exempt organization division and I was told that if an exempt organization has not filed for multiple years, the IRS is really only interested in getting the last 4 years 990s. So I really don't think the IRS wants 2002 and 2003 from your client. Why not give the IRS a call and see what they say before you spend your time and the client's money on preparing possibly unnecessary 990s? 1-877-829-5500 Once the prior overdue 990's are filed, expect to get at least one penalty notice for several thousand dollars. Be prepared to write a letter requesting abatement due to reasonable cause: (1)first time client was responsible for filing this type of return (2)client has no history of non-compliance (3)client discovered and corrected the failure to file before being notified by the IRS, thereby demonstrating that the client acted reasonably and in good faith (no willful neglect). (4)client has put procedures in place to prevent future instances of non-compliance with respect to form 990 filing requirements. That should do it. | |

| Call ProSeries. They may get you the old programs for a small fee or for free. Lacerte does that. | |
