| Currently husband has HSA thru his work, where he gets a W-2. It
covers him, wife and 2 kids. Can the Wife, who has a Sch C, take out her own HSA, and take herself off of his plan. I think not, as they are MFJ, and can only deduct $5,250 per year, which I assume he is already doing. I dont think he can do $5,250 and she could do an HSA for $2650. Thanks Harlan Levinson, CPA | |

| I need to hear from an HSA expert!
I am controller of a company that has two employees who are married. The husband has a High Deductible Medical Plan. The wife is on his plan. The husband has an HSA. The wife does not. According to the IRS, the wife is an "eligible individual" because she is deemed to have a High Deductible Medical Plan because she is a spouse on her husband's plan. The question I have is this: Can the wife contribute, pre-tax (section 125 contributions) to her husband's HSA????? I say no, but I have called the IRS a couple of times and they say, "Yes." I think this is wrong, since I find in the regs that say, "each spouse who is an "eligible individual" as described in section 223(c)(1) and wants to make contributions to an HSA must open a separate HSA. Thus, only one person may be the account beneficiary of an HSA." BUT also in the regs it says, "family members may also make contributions to an HSA on behalf of another family member as long as that other family member is an eligible individual." Isn't the wife considered a family member? But what is confusing here is when the IRS says, "contributions" I think they are talking about after tax contributions. The wife cannot do pre-tax contributions out of her payroll check into her husband's account??? Am I correct in understanding this issue???? Please help me!!!! Thank you! | |
