Taxpayer over age 65 - enrolled in Medicare Part A, but not Part B. His employer adds him to their HSA plan - pays $700 for this employee. $190 in medical claims paid in 2007 out of HSA money. IRS intructions says person on Medicare not elgible for HSA. Employer says that means Part B. I am about to just check the "no" box on Medicare and give up. And if I convince employer that HSA not available - how to reverse. Employer gets back $700 and taxpayer pays the $190 medical bill? Am I all wet?
