| A client (FL resident) brought me her info just yesterday and much to my surprise there is a 1099-S for a piece of property that was sold in GA. There is an Affidavit of Seller's Gain attached to the 1099-S that shows this property was sold at a loss and therefore no state income tax was required to be withheld from the sale. Is it necessary for me to prepare a GA tax return to show that this sale was a loss?

| I have a hunch that Affidavit was not filed with with 1099-S that went to either IRS or GA. That means they only know the gross sales price and you probably have a requirement to file and show the loss. Filing heads off any later "love letters" to your client from GA and you get to charge for another return!
