With regard to the new filing requirements for a 501(c)(3) organization with under $ 25,000 gross receipts to e-file, what is the feeling of Almanacers when the organization files a 990 or 990-EZ with IRS as a matter of policy, even though it's not required to? Does the post card have to be e-filed in addition, or does the paper or e-file of 990/990-EZ override the 990-N?

I have some exempt organizations, that although they are under the filing threshold, do so anyway, since the state requires a filing regardless of Federal rules, and requests a copy of the Federal form (if filed).

Good question. Some donors want to see the 990 too.

BL, I think he's asking whether the 990-N needs to be filed if the 990-EZ is filed instead. I would think it is not required. The goal is to get some kind of minimal information from these organizations, and the 990-EZ provides way more than the post card.

What about this? Will Guidestar.org publish the 990-N information?

According to a publication I get from PPC, the 990-EZ will fulfill the requirements of reporting for the 990-N as long as the 990-EZ is completed in its entirety.

I filed some 990-EZ forms with under $25,000 gross receipts, the IRS responded advising me I did not need to do so and to file the 990-N instead for the coming year. If you want the form to show up on guidestar, file the return, it will help in qualifying for grants. Only one filing is necessary

Can I file Form 990 or Form 990-EZ instead of the e-Postcard?

Yes, but please note that if you choose to file an annual information return (Form 990 or Form 990-EZ) instead of the e-Postcard, you must file a complete return. An incomplete or partially completed Form 990 or Form 990-EZ will not satisfy the annual filing requirement.

John, I find it curious that the IRS sent you notices stating your clients are not required to file 990-EZs. I've been recommending to most of my clients that they do file 990 or 990-EZ for several reasons, one of which is so that the statute of limitations starts running. I wonder how, or if, the 990-N will have any impact on the statute. Has anyone heard anything about that?
