Have client in Virginia, married but they want to file single. I think I have to file them MFS but have heard since they are not in Community Property state they can file on their own. Other problem is they purchased a home together. Both of their names on title and both pay the payments.

There was a long discussion on this filing status question within the past two weeks, but that concerned when did a marriage end. Of course, they only have two choices, and Single is not one of them.

What was their marital status on 12/31/2007? If married and they lived together, even 1 day, during the last 6 months of the year, their options are MFJ or MFS.
