| A client just received a letter from the IRS stating that she may qualify for EIC that was not claimed on her 2008 return. All she needs to do is fill out this easy little EIC Eligibility Checklist and the IRS will do the rest.
I know she does not qualify for EIC due to negative SE income that was reported on a K-1 issued to her. I think the IRS is overlooking this issue. However, the EIC Checklist asks nothing about income; just dependents and their ages. Ethical question: Should I advise the client to go ahead and prepare this checklist knowing that they do not qualify for EIC? | |

| While I was dating my wife, she recieved one of these letters. When i did her taxes back then, she had missed EIC eligibility by about $100 in income (401K withdraw). Anyways, she signed and returned the letter...then a month or two later recieved another letter saying that after further analysis she wasn't eligible. | |
