Can someone file a 2004 tax return and receive the EIC on their tax return as long as that does not give them a refund? What is the deadline on the EIC? I understand that it is too late to receive a refund for a 2004 tax return but in this case, the EIC would only offset some of the SE owed.

Yes. See ISRAEL v. U.S., 93 AFTR 2d 2004-575 (356 F.3d 221).
