| Does anyone know the IRC or where I can find the IRC on double taxation for taxpayer's who file single, but amend to file jointly? I know that they cannot be double taxed, but so far my search has only come up with results relating to corporations, foreign income, and gift tax. | |

| Were the original returns filed single or MFS? If MFS, just amend one return to MFJ and add the other's income.
If both filed single (by mistake? didn't know they were married or?) then file and amended return for the spouse "zeroing" it out - in other words change all the lines to show no income or expenses. Under explanation say that this return is being zeroed out so that the income and deductions can be added to an amended joint return and give the other persons name and SS#. Then file and amended the return for the other partner changing the status to MFJ and adding the other income and deductions. | |

| Thanks, that is what I did. They were single and HOH, but immigration needs to see MFJ returns. | |

| If immigration wanted to see five dependency exemptions and a specific income amount - would you prepare the return that way - regardless of the facts? | |

| We did not do the original returns, so I don't really understand why it was done the way it was. I don't think they even qualify for EIC based on income. | |
