my client lives with his girlfriend and her 8yr old child, girlfriend has no income. he supports both and pays household upkeep. he wants to claim both. can he claim the 8yr old child even though the mother lives in the same household? Quikfinder/Taxbook say child is qualifying child of mom so boyfriend cannot claim, help!

Under the qualifying relative standard, if she is not required to file a tax return you could make the argument. It has to be for the entire year and all the other tests must be met.
