I have a client who lives with his girlfriend (both are 51 years old) in an apartment. They have lived together for 6 years.

For 2008, he has $40K in taxable income, she is disabled and received $16K in Social Security Benefits.

What are filing options? Can he file as Head of Household without claiming her as dependent?

He cannot file HOH. When claiming a dependent, a non-relative can be a qualifying relative. Not so for HOH. As he has no qualifying relative, HOH is out for him.

His filing option is to file single.
