| Can a child who is 19 on 12/31/05 be claimed as a dependent if he is still living at home, not a student, and has no income? A joint return is being filed. He meets all of the dependency tests but he is over 19 at the end of the year. | |

| No, what I am saying is that a dependency exemption may not be claimed for an individual who files a joint return unless the individual was exempt from the filing requirements. | |

| Yes, the 19 year old does qualify as an exemption becaaue of not income. The income limit for not filing for the 19 year old would be $3,200 . And the 19 would still qualify as an exemption if he was married and they were only filing for a refund. | |
