Can a child who is 19 on 12/31/05 be claimed as a dependent if he is still living at home, not a student, and has no income? A joint return is being filed. He meets all of the dependency tests but he is over 19 at the end of the year.

Yes. One can also claim a great great grandfather who is 100.

Then the child is a dependent.

No, what I am saying is that a dependency exemption may not be claimed for an individual who files a joint return unless the individual was exempt from the filing requirements.

Yes, the 19 year old does qualify as an exemption becaaue of not income. The income limit for not filing for the 19 year old would be $3,200 . And the 19 would still qualify as an exemption if he was married and they were only filing for a refund.
