H died 7/1/09. 2008 H & W filed MFJ

Box 7a - Do I need to name E...I don't believe so since listed on Box 3.

Box 10 - Death of Spouse?

Box 11 - 7/2/09?

Box 12 - December?

Box 13 - 0 0 0

Box 16 - Other_________Estate?

Or is Boxes 11 - 16 not required since this is not a business entity?

NEVER fill out a form ASSUMING anyone is an executor.

While I appreciate your professinal concern, I am merely just wanting to know the correct procedure RE: SS-4 for obtaining a EIN for, and it has been confirmed, W is Executor, her H estate!

then the answer is 'that you fill in the blanks as requested' - date entity created would be date of death, date of year end - best select a fiscal year for now, but SS-4 isn't controlling, the 1041 is.

Given the updated replies and info are these correct for the respective Boxes on SS-4?

No other changes or appointments by a court have been made RE: Completing Form 56.

Read the will. If no will, there's no executor. You have an administrator instead. In either case the court may be involved. Speak the the estate's atty.
