All all providers of tax advice/tax preparation now required to provide a circular 230 disclosure in their communications with clients? Does this include enrolled and unenrolled individuals? What does the law state exactly?

What are some examples of the addendum others are using in e-mail transmissions? How do you get it into the e-mail so it always shows up? I know that seems like a basic question to a lot of people, but I've never figured out how to put in an electronic signature. I've heard that some people add a very lengthy comment that pretty much covers everything from "No Mom, I swear I didn't break it", to "This is clearly not tax advice in any way shape or form." J- I checked your link but didn't find a clear statement suggested there.

Action, at MS Outlook, go to Tools, Options, then click on Mail Format, it's at the bottom: Signatures. You might have to tinker around with it (as I had to do).

A lot more disclosures will be filed, and the Service will be back where they started (you can't look into every one of them). What burns me up about this is that it originated not from the malfeasance of the small practitioners, but from the fact that the tax shelter schemes by the big boys had gotten so clever, they had to be disclosed to be understood.

Anyone like to comment on what they will be doing this coming year for mileage logs and M&E documentation? If they don't provide it to you are you going to file a disclosure?

Okay, I missed something here I think. I do not have any clients with tax shelters and I don't really do much tax planning, so I was never too concerned about Cir. 230. Now there are comments about possibly disclosing whether certain items such as M&E and mileage have proper documentation? If that is truly an outcome of this proposal, then we ALL need to send in comments.

Wayne, I have a little statement on the Client Questionaire that I send to even the business client, and the client states to me they have kept the proper records. They have to sign my Questionaire. Most of my clients do complete the questionaire, though I have a few who never do, and I sit down with those usually.

Natalie: I use an engagement letter for tax returns that I got at a Bob Jennings seminar, which are a little on the long side, but most of my clients have not balked. Then, I use a Questionaire for most clients that I think I got off of NSA. On this whole Circ. 230 subject, I think the impact is not really going to be known until we see how the IRS treats it, but it's definitely worth taking some ethics CPE or CLE etc on it.

One thing I'm worried about is the clients that ask what their mileage was last year when we get to that section of the return.
