T/P lives with boyfriend has MaryKay Business. If she can show she has one room for her office and is used exclusivley for her business can she qualify for In-Home Office? I would say yes, however would not be able to take depreciation since she does not own the home. Would be treated as if she rents an apartment. Also would not have any indirect costs unless she can show she specifically paid these costs or would that fall under the depreciation reqiirement?

If can't qualify for In Home Office, then won't her business mileage only start from her 1st client to 2nd client and or other business purpose desigination but any mileage from her home to 1st client or last client to home would be considered comutting mileage correct?

Does she pay any of the housing expenses? Does she pay her boyfriend rent? If she doesn't pay anything then what is she going to deduct? It doesn't sound like she's got a deduction.

Is there a specific requirement that it has to be an entire room?

My understanding is that a filing cabinet in a corner qualifies if use is exclusive.

Reply: That is still to be determined on what expenses or rent she does pay. If no outlay then you are right NO DEDUCTION!

My understanding is that a filing cabinet in a corner qualifies if use is exclusive REPLY: I believe that just having a filing cabinet say in the corner of a kitchen will not qualify it should be generally a separate room used "regularly" and "exclusively" for her business. I just used an Ex. I heard of a T/P tried and it failed in an audit since it was considered a "common area" used for personal also.

My book is not with me. If she spent no money in renting - of course no office expenses can be deducted. But, I have the idea that business mileages can be considerer as Duce said.. Am I right??
